Changes

We retain the right to modify our services and these terms
and conditions at any time. If any conditions are deemed invalid or
unenforceable, this will not affect the validity of the remaining conditions.

Definitions

  • Online Booking: A booking made online through our website or mobile app.
  • Radio Taxis Winchester: Radio Taxis Winchester Limited, a company registered in England and Wales.
  • Airport Booking: A booking to or from any airport.
  • App: Our mobile application.
  • Booking: A request for services made by a customer, as documented by us.
  • Card Payment: Payment made via methods other than cash, check, or direct debit, including credit or debit cards.
  • Charges: Fees as displayed in our Price List or communicated during the booking process.
  • Christmas Period: The period from 18:30 hours on 24th December to 23:59 hours on 25th December (double pay), and from 00:01 hours on 26th December until 6:00 hours on 27th December (time and a half), with all other bank holidays also being time and a half.
  • Pickup Address: The address specified by the customer as the pickup location.
  • Customer/You: Refers to individuals, firms, or companies booking our services.
  • Destination Address/Drop-off: The address specified by the customer as the drop-off location.
  • Driver: The individual operating the passenger vehicle, licensed by City Council.
  • Passenger(s): Includes the customer and any individuals authorized to use the passenger services.
  • Passenger Services: Transportation of passengers, including applicable luggage or bicycles, using a passenger vehicle.
  • Passenger Vehicle: Any vehicle, such as a car or van, used for passenger transportation.
  • License: Drivers operating under Radio Taxis Winchester are licensed by City Council.
  • Price List: A maintained list of charges for our services, accessible upon request.

Services:

  •     Passenger Services: The transportation of passengers.
  •     Other Services: Any additional services agreed upon in writing.

  • Vehicle: A passenger vehicle licensed by Winchester City Council.
  • Waiting Time Charge: A charge of £25 per hour, payable in one-minute increments.

Booking Type:

  •  Bookings can be made online through our website or app.
  • Phone bookings are also accepted.
  • Airport bookings must be made with a 24-hour notice.
  • Payments are made via BACS for non-account bookings.

Non-Account Bookings:

  • For non-account bookings, we act as the disclosed agent of the driver, arranging and confirming bookings between the driver and the customer.
  • Payments for non-account bookings can be made directly to the driver in cash or via card payment processed by a third-party payment processor on behalf of the driver.

Passenger Services:

  • The price quoted at the time of booking is based on the specified journey (the “Quoted Journey”).
  • The quoted price is determined by our chosen route between the Collection Address and the Destination Address, including any additional pick-up or drop-off points specified by the customer.
  •  If specific charge rates have been agreed upon by Radio Taxis Winchester, those rates will apply.
  •  For Airport Bookings, we allow 1 hour of waiting time from the last known estimated arrival time of an inbound international or domestic flight. This waiting time includes the first hour.
  • We monitor flights if the customer provides a flight number; otherwise, we use the time specified by the customer for the Airport Booking.
  • Additional waiting time charges may apply after the initial waiting period.
  •  If the customer requests additional pick-ups, drop-offs, route changes, or deviations from the Quoted Journey, additional charges may be applied.
  • We may seek customer consent for amendments before implementing them.
  • Traffic conditions, such as road works and weather, are beyond our control, and we are not responsible for any delays affecting flight, train, or coach bookings.
  • Customers should allow sufficient time for their journeys.
  • For groups larger than four passengers, additional charges may apply.
  • During the Christmas Period, surcharges will be communicated during the booking process.
  • Customers must inform us if they wish to transport bicycles, and our rates for transporting bicycles will apply.
  • Please note that only specific vehicles are equipped to carry bicycles.
  • In cases where customers have not informed us of their bicycle transportation requirements, the driver may choose to cancel the booking or suggest an alternative vehicle.
  • We make reasonable efforts to provide a well-maintained
  • Passenger Vehicle of the specified type. If such a vehicle is unavailable, a reasonable alternative will be provided.
  • Customers must inform us when booking if they intend to transport domestic animals. All animals must be appropriately restrained or carried in a suitable locked box or cage. Failure to notify us may result in booking cancellation and relevant cancellation fees, except for guide dogs, which are exempt.
  • Smoking is prohibited in all Passenger Vehicles, including electronic cigarettes.
  • Alcohol consumption is not allowed in Passenger Vehicles,
    and we reserve the right to refuse carriage or require a passenger to exit a vehicle if they are intoxicated or pose a danger to the driver, vehicle, or other passengers.

Cancellations and Refunds:

  • Details about our cancellation policy, including deadlines
    and associated fees, can be found on our website.
  • Refund policies are determined on a case-by-case basis and
    depend on the nature of the cancellation.

Conduct:

  • We expect all passengers to treat our drivers, vehicles,
    and fellow passengers with respect.
  • Disruptive, unsafe, or inappropriate behavior may result
    in the termination of the journey and reporting to local authorities, if
    necessary.

Liability:

  • Except as expressly provided in these Terms or required by
  • law, we make no warranties or representations, and all warranties or conditions of quality, merchantability, or fitness for a particular purpose are excluded to the fullest extent permitted by law.
  • Customers are responsible for ensuring passenger compliance with these Terms, and they shall be liable for any breaches.
  • We are not liable for any loss or damage suffered by the customer or passengers, including property loss or theft, in several circumstances, including but not limited to passenger misuse of the vehicle, acts or omissions of passengers, drivers, or third parties, and Force Majeure Events.
  • In cases of delay, missed collections, missed drop-offs, or late arrivals at destinations, our liability is limited to refunding the Charges paid for the affected booking. We are not responsible for other losses, including business interruption or loss of profits.

Privacy Policy:

Passenger data collection is governed by our Privacy Policy,
available on our website.

Complaints and Feedback:

We encourage passengers to provide feedback and address
complaints. Please contact our customer service department for assistance.

Changes to Terms & Conditions:

We reserve the right to modify these Terms and Conditions, and updates will be
posted on our website.

Force Majeure:
We are not liable for delays or failures in fulfilling our obligations under these terms due to Force Majeure Events.

 
Applicable Law:
These terms and Conditions are governed by the laws of Winchester City Council. Any disputes will be subject to the exclusive jurisdiction of the courts in Winchester City Council.
Quotations:
  • Our quotations for taxi services are primarily based on the distance to be traveled and the type of service requested. These quotations are provided to you at the time of booking and are subject to change only under specific circumstances.
  •  Please note that quotations are estimates and may vary based on actual travel conditions. Unusual traffic patterns, road closures, detours, or unforeseen circumstances beyond our control may impact the final fare.
  •  In cases where the journey deviates significantly from the initially estimated distance or duration due to the aforementioned factors, additional charges may apply. These additional charges will be communicated to you by our driver or customer service representative during or after the journey.
  •  We are committed to transparency, and any changes to the fare will be explained to you clearly. We encourage you to discuss any concerns or discrepancies regarding the fare with our driver or our customer service team before concluding the journey.
  • While we strive to provide accurate quotations, please be aware that the final fare may differ from the initial estimate in certain situations. We appreciate your understanding in such cases.
  •  By booking our services, you acknowledge and accept the possibility of variations in the fare due to factors beyond our control, and you agree to pay the final fare as determined at the end of your journey.
  • For any questions or concerns regarding quotations, fare adjustments, or billing, please do not hesitate to contact our customer service department. Your satisfaction is important to us, and we are here to address any inquiries you may have.

General

  • These Terms and Conditions, along with any documents
    expressly referred to, constitute the entire agreement between the parties.
    They replace and supersede all prior agreements, whether written or oral.
  • Each party acknowledges that they do not rely on any
    statements or representations not included in these Terms.
  • No variations to these Terms will be effective unless they
    are in writing and signed by the parties or their authorized representatives.
  • These Terms and any disputes arising from them are
    governed by the law of England and Wales, with the courts of England and Wales holding exclusive jurisdiction.
